    1. Acceptance of Terms

    By accessing or using RentButler ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

    2. Description of Service

    RentButler is an AI-powered property management platform that provides tools for managing rental properties, including lease document management, tenant tracking, digital signing, AI-powered data extraction, and portfolio analytics.

    3. Account Registration

    To use certain features of the Service, you must register for an account. You agree to:

    • Provide accurate, current, and complete information during registration
    • Maintain and promptly update your account information
    • Maintain the security of your password and accept responsibility for all activities under your account
    • Immediately notify us of any unauthorized use of your account
    • Be at least 18 years old to create an account

    4. Subscription and Payments

    4.1 Billing

    Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for the applicable subscription fees.

    4.2 Free Trial

    We may offer free trials. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

    4.3 Refunds

    Refunds are handled on a case-by-case basis. Contact our support team within 30 days of your payment if you believe you are entitled to a refund.

    5. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful purpose or in violation of any laws
    • Violate any applicable fair housing laws or regulations
    • Upload malicious code, viruses, or harmful content
    • Attempt to gain unauthorized access to our systems
    • Interfere with or disrupt the Service or servers
    • Scrape, data mine, or use automated systems to access the Service
    • Impersonate another person or entity
    • Use the Service to send spam or unsolicited communications

    6. Your Content

    You retain ownership of all content you upload to the Service ("Your Content"). By uploading content, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you.

    You are responsible for ensuring you have the right to upload and use all content, including lease documents, tenant information, and property data.

    7. AI Features and Data Processing

    Our AI features process documents you upload to extract lease data and provide insights. You acknowledge that:

    • AI-extracted data should be reviewed for accuracy before relying on it
    • We are not responsible for errors in AI-generated content
    • Your documents are processed securely and not used to train AI models
    • AI features are provided "as is" and may not capture all document details

    8. Digital Signatures

    RentButler provides electronic signature functionality. By using this feature, you agree that electronic signatures are legally binding and have the same legal effect as handwritten signatures. You are responsible for ensuring compliance with applicable e-signature laws in your jurisdiction (such as ESIGN Act and UETA).

    9. Third-Party Services

    The Service may integrate with third-party services (payment processors, tenant screening providers, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

    10. Intellectual Property

    The Service and its original content (excluding Your Content), features, and functionality are owned by RentButler and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without permission.

    11. Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT A LAW FIRM AND DO NOT PROVIDE LEGAL ADVICE. CONSULT A LICENSED ATTORNEY FOR LEGAL QUESTIONS.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTYTRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

    13. Indemnification

    You agree to indemnify and hold harmless RentButler from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

    14. Termination

    We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may export your data before termination.

    15. Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

    16. Governing Law

    These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.
